These Terms and Conditions ("Terms") govern your purchase and use of digital products sold through freelanceos.pro ("Website"), operated by AI Freelance OS ("Company," "we," "us," or "our"). By completing a purchase, you agree to be bound by these Terms. Please read them carefully before buying.

1. Definitions

"Product" refers to any digital product sold through our Website, including but not limited to ebooks, prompt libraries, templates, spreadsheets, interactive tools, and related digital files. "Customer," "you," or "your" refers to the individual or entity purchasing the Product. "System" refers to the complete AI Freelance OS methodology, including the ebook, prompt library, templates, dashboards, scripts, and calendars sold as part of the Product package.

2. Nature of the Product

All Products sold through this Website are digital goods delivered electronically as downloadable files immediately upon purchase. Due to the digital nature of these Products, they cannot be returned, exchanged, or "un-downloaded" once delivered. By purchasing, you acknowledge that you are buying a license to use digital content, not a physical product.

3. License and Permitted Use

Upon successful payment, we grant you a non-exclusive, non-transferable, personal license to use the Product for your own personal and business purposes. This means:

You may use the templates, prompts, and frameworks in your own freelance business.
You may modify and adapt the templates, scripts, and prompts to fit your specific needs.
You may use the AI-generated outputs from the prompts in your client work, proposals, and marketing.
You may not resell, redistribute, share, or make the Product files available to any third party, whether for free or for a fee.
You may not claim authorship of the Product or its contents.
You may not include the Product (or substantial portions of it) in any product you sell or distribute.
You may not upload the files to any public repository, file-sharing service, or torrent site.

Violation of these license terms may result in immediate termination of your license without refund, and we reserve the right to pursue any available legal remedies.

4. Intellectual Property

All content within the Product — including text, frameworks, prompt designs, template structures, layouts, and branding — is the intellectual property of AI Freelance OS and is protected by copyright law. Purchasing the Product does not transfer ownership of any intellectual property rights to you. You are purchasing a license to use the content, not ownership of the content itself.

5. Payment and Delivery

All payments are processed securely through our third-party payment processor (Payhip) using Stripe and/or PayPal. Prices are displayed in euros (€) unless otherwise stated. All prices include applicable taxes where required by law. Upon successful payment, you will receive immediate access to download the Product files. A confirmation email with download links will also be sent to the email address provided at checkout.

6. EU Right of Withdrawal — Waiver for Digital Content

Important Notice for EU/EEA Customers

Under the EU Consumer Rights Directive (2011/83/EU), you normally have a 14-day cooling-off period to withdraw from an online purchase without giving a reason.

However, this right of withdrawal does not apply to the supply of digital content that is not supplied on a tangible medium (such as downloadable files), where:

(a) the performance has begun with your prior express consent, and
(b) you have acknowledged that you thereby lose your right of withdrawal.

By completing your purchase and accessing the download, you expressly consent to immediate delivery of the digital Product and acknowledge that you waive your 14-day right of withdrawal.

This waiver is obtained through an explicit checkbox at checkout confirming your consent. If you do not agree to waive this right, please do not complete the purchase.

7. Refund Policy

7.1 General Policy — No Refunds on Digital Products

Due to the instantly downloadable nature of our Products, all sales are final and no refunds are offered as a general rule. Once the Product files have been delivered (made available for download), the transaction is considered complete.

7.2 The 30-Day "More Clients" Performance Guarantee

Despite the general no-refund policy above, we voluntarily offer a conditional 30-day performance guarantee on the Complete System and Pro packages. This guarantee is subject to the following conditions:

To qualify for a refund under this guarantee, ALL of the following conditions must be met:

Full implementation required. You must have genuinely implemented the complete system as described in the ebook and Quick Start Setup Guide. This means completing at minimum: the positioning exercises from Module 1 (Offer Canvas, Pricing Calculator), setting up and executing the lead generation system from Module 2 (content calendar, outreach sequences), and using the sales tools from Module 3 (discovery call prep, proposal template).
Documented evidence. You must provide reasonable evidence of implementation, such as: screenshots of completed templates, examples of content published following the content calendar, examples of outreach messages sent using the scripts, and/or evidence of the pipeline dashboard in active use.
30-day minimum usage period. The refund request must be made no earlier than 30 days and no later than 45 days after the date of purchase. Requests made before 30 days will not be considered because the system requires a minimum of 30 days to generate results. Requests made after 45 days will not be considered.
No qualified leads generated. Despite full implementation as described above, you must not have generated at least one (1) new qualified lead — defined as a prospect who has responded positively to your outreach or content and expressed interest in your services.
Good faith. The guarantee is offered in good faith and is intended for customers who genuinely implement the system and do not see results. It is not intended as a way to obtain the Product for free. We reserve the right to deny refund requests that show evidence of bad faith, including but not limited to: downloading the files and immediately requesting a refund, providing fabricated evidence of implementation, or using the guarantee as a mechanism to obtain the materials without payment.

To request a refund under this guarantee: Send an email to support@freelanceos.pro with the subject line "30-Day Guarantee Refund Request" including your order number, date of purchase, and the evidence of implementation described above. We will review your request within 7 business days and respond with our decision. If approved, the refund will be processed within 14 business days using the original payment method.

7.3 Exceptions

We will also consider refund requests in the following limited circumstances, regardless of the above conditions:

Technical issues: If the Product files are corrupted, unreadable, or otherwise technically defective and we are unable to provide working replacement files within 48 hours of your report.
Duplicate purchase: If you accidentally purchased the same Product twice, we will refund the duplicate charge upon verification.
Misleading description: If the Product is materially different from what was described on the sales page at the time of purchase.

7.4 Starter Tier

The 30-Day "More Clients" Performance Guarantee applies only to the Complete System and Pro packages. The Starter tier (ebook only) is sold under the general no-refund policy described in Section 7.1, as it does not include the full implementation tools required to execute the system.

8. Disclaimer of Results

The AI Freelance OS is an educational and strategic product. It provides frameworks, templates, prompts, and systems designed to help freelancers improve their client acquisition and operations.

We do not guarantee any specific results, income, or outcomes. Your results will depend entirely on your individual effort, skills, market conditions, niche, implementation quality, and many other factors outside our control. Any examples, case studies, or testimonials referenced in our marketing materials are illustrative only and should not be interpreted as promises or guarantees of similar results.

The Product is not a substitute for professional business, legal, financial, or tax advice. We recommend consulting with qualified professionals for decisions specific to your business situation.

9. AI Tools Disclaimer

The Product includes prompts and workflows designed to be used with third-party AI tools (such as ChatGPT, Claude, Gemini, and similar services). We are not affiliated with, endorsed by, or responsible for any third-party AI tool. The output quality of AI-generated content depends on the AI tool used, its current capabilities, and how the prompts are customized. AI tools may change their features, pricing, availability, or output quality at any time without notice. We are not responsible for any changes to third-party AI tools that may affect the usefulness of specific prompts or workflows. The prompts in this Product are designed to be platform-agnostic and transferable across major AI assistants.

10. Limitation of Liability

To the maximum extent permitted by applicable law, AI Freelance OS and its owner(s) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use or inability to use the Product.

Our total aggregate liability arising from or related to these Terms or the Product shall not exceed the total amount you paid for the Product.

Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

11. Updates and Modifications

We may update the Product from time to time to improve content, add new templates, or reflect changes in AI tools and best practices. If we described the Product as including "lifetime updates" at the time of your purchase, you will receive access to updated versions at no additional cost for as long as the Product remains commercially available. We are not obligated to provide updates indefinitely, and "lifetime" refers to the commercial lifetime of the Product, not the lifetime of the purchaser.

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Changes do not apply retroactively to purchases made before the update.

12. Privacy

We collect only the information necessary to process your purchase and deliver the Product: your name, email address, and payment information (processed securely by our payment processor). We do not sell, share, or rent your personal information to third parties. For email communications, you may unsubscribe at any time. Our payment processor (Payhip) and payment gateways (Stripe, PayPal) have their own privacy policies, which we encourage you to review.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. For EU consumers, nothing in these Terms affects the mandatory consumer protection rights available under the laws of your country of residence. Any dispute arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts in Madrid, Spain, subject to any mandatory consumer jurisdiction rules that may apply.
